Belgium Intervenes in ICJ Gaza Genocide Case
The ICJ confirmed that Belgium filed its declaration on December 23, citing Article 63 of the Court’s Statute. This provision allows states that are parties to a convention under review in ICJ proceedings to intervene.
Belgium clarified that its involvement centers on Articles I through VI of the Genocide Convention, with particular emphasis on Article II, which addresses the interpretation of the "specific intent" required to establish genocidal intent.
In accordance with Article 83 of the Rules of Court, the ICJ has invited both South Africa and Israel to submit written comments on Belgium’s intervention.
South Africa originally brought the case against Israel on December 29, 2023, alleging violations of obligations under the Genocide Convention in its actions toward Palestinians in Gaza. Since then, the ICJ has issued several provisional measures directing Israel to take steps to prevent acts of genocide.
The ICJ, headquartered in The Hague, serves as the UN’s principal judicial body and resolves legal disputes between states.
